Hall of shame. Convicted PNP councillor continues to hold unto his post

The PNP members continues to exhibit total disregard for rules of law and appears to lack the moral compass to do what is right, with such regularity, it is frightening.

The Mayor of May Pen was charged with a criminal offence but continues to sit in office.

The Mayor of Portmore time has expired, yet he continues to illegally occupy (squat) the position of Mayor of Portmore.

The worst of all however is the position taken by Councillor Dwight Burke from the Silogiville division, who was convicted and sentenced to 24 months in prison or $500,000 for causing death be dangerous driving.

It is beyond comprehension that such a councillor, could continue to sit in Parish Council deliberations and be paid by the Jamaican public, how on earth could this be so.

The Parish Council Act specifically states that if a councillor is sentenced anywhere in the commonwealth to a period exceeding 12 months, that seat held by the councillor immediately become vacant.

This means that Councillor Dwight Burke is illegally occupying that Parish Council seat at the St Catherine Parish Council and must be immediately booted and all salaries paid since his conviction must be reimbursed to the tax payers of Jamaica.

Once again, the PNP members continues to show who  they are made of, flouting laws acting illegally, showing lack of moral compass and amazingly, the Jamaican public has allowed them to continue to get away with this.

What does this also suggest about our people ?

This illegal act must not proceed beyond the end of the today, July 15, 2014 !

  1. It would be good to hear from Wayne Jnr on this, but I doubt he will expose himself in public on this issue.

      Jay, I made some minor changes to what you wrote to make it more accurate. First, if he was sentenced as you stated, why is he on the street and serving? He was NOT sentenced to 24-months and would serve time if he elected NOT to pay the fine. Now no one in the right mind would serve a prison sentence if they can pay a fine. So technically, he wasn’t sentence and as such able to continue in his position. The fact that the case is on appeal was intentionally not mentioned. Until the appeal is exhausted, he is still a free man.

      It is interesting how you deliberately left out pertinent information or made errors (of v’s OR) to make your story more palatable. Shame on YOU Jay!

  3. This is unacceptable. I would suggest that you send a complaint to the AG, they are also mandated to act. it is sad when lawmakers become lawbreakers.

  4. Also James Forbes is also illegal in his capacity. Follow up on that one too

    • As far I know, James Forbes is no longer a cop and if he loses his appeal, he will also lose his pension.

      • Senior Superintendent Harry Bungles was sentenced to 18 months in prison, caught red-handed collecting extortion money (#20K monthly), appealed and eventually the case was thrown out on appeal. He is still a police officer. The funny part was the guy he attempted to shakedown, Tafari Clarke) was a convicted drug dealer in the UK and Bungles stated that he was collecting on a loan from the guy’s father, a know Community Don (according to unofficial sources).

        • As much as many of us did not like what occurred, they law is the law. He was reinstated after he was his appeal, which effectively states he was a “innocent” man.

          I hope you are not trying to draw a parallel between this and the Councillor. He was found guilty and sentenced, so are you suggesting that he Dwight is still innocent until the appeal process is completed ?

      • i urge you to check, The same argument was posited that he would be appealing. But the law said about conviction. If you appeal, then you apply for reinstatement.

        The commish lambasted Kartel, even though he is appealing his sentence. Yet he is treating Forbes as innocent, because his case is under appeal. let us know if James Forbes is collecting his salary

        • The police regualtions of 1961 says the following

          34.-(1) Where criminal proceedings have been instituted against
          a member, disciplinary proceedings upon any grounds arising out of
          the criminal charge shall not be taken until after judgment has been
          given and the time allowed for an appeal from the judgment has
          expired; and where a member after conviction has appealed disciplinary proceedings shall not be taken until after the withdrawal or determination of the appeal.

          (2) Nothing in this regulation shall prevent the member being
          interdicted from duty pursuant to regulation 35.
          35.-(1) Where-

          (a) any disciplinary proceedings or criminal proceedings have been
          or are about to be instituted against a member; or

          (b) the authorized officer becomes aware of any misconduct on
          the part of a member below the rank of Inspector; and

          (c) the Commission or as the case may be the authorized officer
          is of opinion that it is necessary or desirable in the public
          interest that that member should forthwith cease to perform
          his functions as such member,
          the Commission may recommend or as the case may be the authorized
          officer may direct that that member be interdicted from such performance.

          (2) A member so interdicted shall, subject to the provisions of
          regulation 34, be permitted to receive such proportion of the salary
          of his rank, not being less than three-quarters, as the Commission may
          recommend to the Governor-General or, as respects a member below
          the rank of Inspector, as the Commissioner may decide.

          (3) If disciplinary proceedings against any such member result
          in his exculpation, he shall be entitled to the full amount of the salary
          which he would have received if he had not been interdicted; but if the
          proceedings result in any punishment other than dismissal the member
          shall be allowed such salary as the Commission may in the circum-
          stances recommend or, as respects a member below the rank of
          Inspector, as the Commissioner may decide.

          (4) A member who has been summoned or arrested on
          a criminal charge may be forthwith interdicted from duty or suspended
          from duty without pay and deprived of all uniform and other
          Government property in his possession. If admitted to bail he may
          be prohibited from living in a station but shall be permitted to earn
          his livelihood as if he were not a member.

          (5) A member who is under interdiction or suspension from
          duty may not leave the Island without the permission of the Governor-
          General acting on the recommendation of the Commission and shall
          give to his Divisional Officer an address at which he may be found.

          (6) All documents required to be served pursuant to these
          Regulations on a member who is under interdiction or suspension from
          duty shall be deemed to be properly served if sent by prepaid registered
          mail to the address given by that member in accordance with paragraph(5)

          Finally # 38 & 39

          38 If a member is convicted in any court of a criminal charge Mmkr
          the Commission may consider the relevant proceedings of that court of a and if the Commission is of the opinion that the member ought to be dismissed or subjected to some lesser punishment in respect of the offence of which he has been convicted the Commission may thereupon recommend the dismissal or other punishment of the member without the institution of any disciplinary proceedings under these Regulations

          39. A member convicted of a criminal charge involving dishonesty,
          fraud or moral turpitude or convicted of a criminal charge and sentenced to imprisonment shall not receive any of his emoluments after the date of such conviction pending consideration of his case by the Commission or as the case may be, the Commissioner

          So according to #39, when read in conjunction with # 34 section 1, it means James is most likely still receiving a salary pending the appeal.

          Wayne Jnr don’t jump off on this, as it relates to the actual regulations governing the JCF and as such cannot be used for some other body, which has there own set of rules and regulations.

    Who is Christopher Kerr (or Christopher Carr or Christopher Kerr-Watson or Donavan Watson Kerr, etc.). My understanding is he was the guy who shot to death his unarmed fellow labourite in Manchester at a Labourite gathering? Apparently he shot another guy recently and this guy refuses to cooperate with the police (for fear of his life?).

    Jay, we all know you have impeccable sources, so could you give us the full hundred on your fellow shotta labourite?

    Why does he have so many identities?

    So many driver’s license?

    So many birth certificates?

    So many TRNs?

    He is a licensed firearm holder, so in which name did he get this license?

    How was he able to get a license to carry a Firearm with the police unable to ascertain his true identity?

    Is he a even Jamaican?

    They say he a respectable Real Estate Developer, with projects all over the corporate area. Who really is this Christopher ????? (fill in the blanks).

    We know if he was aligned with the PNP, he would have made the headlines long time ago on your blog. Please use your investigative skills/sources give us the scoop Jay. We expect no less from you……

          I would really like to hear your views on the actions of the councillor, please indulge us in this regard.

        • @jay, Comrade Dwight Burke is a decent human being who made a terrible mistaken of his life, which resulted in the death of a fellow human being. Was it just an accident or negligence on his path? I do not have all the facts of the situation so I cannot comment if the guilty verdict was justified. I will let the justice system run its course and live with the end results of the process. Unlike you, I will not lynch the man just because he so happens to be from the “other” side. The fact that he is appealing the conviction does allow him to continue in his present capacity, unless you know otherwise.

          Your side can’t win elections and want to gain advantages by any means necessary. You are always calling for one elected PNP official to resign, hoping that by some divine intervention one of yours can enter through the back door. Won’t happen. You guys need to win fair and square and I would hope you know what that means. In fact, I now elect you to the Hall of Shame.

        • Let me ask you this question, what would you say to the family of the deceased ?
          If he had “mistakenly” killed one of your family members, would your position be the same ?
